The conditions contained in this document may be modified by LA VITTORIA SRL without prior notice and shall be valid from the date of publication on the website https://www.felicecavallo.it.
ACCEPTANCE OF GENERAL CONDITIONS OF SALE
1. The contract of sale stipulated between LA VITTORIA SRL and the Client, through the website www.felicecavallo.it shall be considered concluded with the acceptance, even partial, of the order by LA VITTORIA SRL, which reserves the right to accept the order. Acceptance shall always be explicit, and shall be communicated to the Client at the e-mail address indicated at the time of ordering. By placing an order in the various ways provided, the Client shall declare that he/she has read all the information provided during the purchase procedure and fully accepts the general and payment conditions described below.
2. If the Customer is a final consumer (a natural person for purposes not related to his/her own professional activity), once the purchase has been concluded through the website www.felicecavallo.it , he/she shall print or save an electronic copy and, in any case, keep these general sales conditions, in compliance with the provisions of Articles 3 and 4 of Legislative Decree no. 185/1999 on distance sales.
3. Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order, is expressly excluded.
PURCHASE MODALITIES
The correct receipt of the order shall be confirmed by LA VITTORIA SRL by means of an e-mail reply, sent to the e-mail address communicated by the Client. Such confirmation message shall contain the Date and Time of receipt of the order and a 'Customer Order Number', to be used in any further communication with LA VITTORIA SRL.
In the event of non-acceptance of the order, LA VITTORIA SRL shall promptly notify the Client.
LA VITTORIA SRL reserves the right to modify prices at any time, without prior notice. Changes to offers and prices shall be valid from the date and time of publication on the website www.felicecavallo.it.
LA VITTORIA SRL reserves the right to accept or refuse an order, even if valid, at its sole discretion.
METHODS OF PAYMENT
The customer can pay by credit card, bank transfer, Postepay and Paypal.
Every purchase takes place in maximum security thanks to the use of sophisticated technological and coding systems (SSL).
All data will be used exclusively to process the order.
The credit cards accepted are all those that use the Visa and Mastercard circuits.
LA VITTORIA SRL in some cases reserves the right to request the Client additional information or the sending of copies of documents proving the ownership of the Card used. In the absence of the requested documentation,
LA VITTORIA SRL reserves the right not to accept the order. At no time during the purchase procedure
LA VITTORIA SRL is not in a position to know the information relating to the credit card of the purchaser, as it is typed directly on the website of the bank that manages the transaction with very high security systems; as there is no data transmission, there is no possibility for these data to be intercepted. No computer archive of LA VITTORIA SRL contains the client's credit card data.
In no case LA VITTORIA SRL can therefore be held responsible for any fraudulent and undue use of credit cards by third parties, upon payment of products purchased on www.felicecavallo.it.
NB: when paying by bank transfer in advance, it is necessary to indicate the order number and the name of the order holder in the reason for the transfer. The order will only be dispatched once the payment has been credited to our bank.
Choosing this payment may delay the dispatch of the order by 2-3 days due to the banking system.
MODE OF DELIVERY
LA VITTORIA SRL currently accepts orders only with delivery within the Italian territory.
LA VITTORIA SRL does not deliver to P.O. Boxes or to companies providing domiciliation services.
For each order placed on www.felicecavallo.it LA VITTORIA SRL shall issue an invoice for the material shipped. For the issuance of the invoice, the information provided by the Client at the time of the order shall be used.
The Client relieves LA VITTORIA SRL from any responsibility deriving from the issuance of erroneous fiscal documents due to errors in the data provided by the Client, being the Client himself the only responsible for the correct insertion. No change in the invoice shall be possible after the invoice has been issued. Shipping costs shall be borne by the Customer and are explicitly highlighted when placing the order. Payment of the goods by the Customer shall be made using the method chosen when placing the order.
Generally, the approximate (non-binding) delivery times are: 4 to 6 working days for deliveries in northern Italy - 5 to 7 working days for deliveries in central Italy - 6 to 8 working days for deliveries in southern Italy. Delivery times of the ordered goods are purely indicative and may be subject to variations due to force majeure or due to traffic conditions and road conditions in general or by act of the Authority.
No responsibility can be attributed to LA VITTORIA SRL in case of delay in the execution of the order or in the delivery of the ordered goods. In the event that the goods ordered and paid for are refused by the Customer, LA VITTORIA SRL shall retain the transport costs and any storage costs.
Upon delivery of the goods by the courier, the Customer shall check:
*that the number of packages delivered corresponds to that indicated in the transport documents
*that the packaging is undamaged, not damaged, not wet or otherwise altered
Any external damage or the mismatch of the number of packages or indications, must be immediately contested to the courier who delivers, putting the wording "withdrawal with reserve" on the accompanying document and confirmed, within 7 days by registered letter with return receipt to LA VITTORIA SRL, Via Madonan della Vittoria n.145, -66100 - CHIETI (CH) Italy and to the courier, whose address is indicated on the accompanying document.
It is also required to open an inspection at LA VITTORIA SRL, by sending an email to info@felicecavallo.it.
Even if the packaging is intact, the goods shall be checked within seven days of receipt. Any hidden damages or anomalies shall be reported in writing by fax or registered mail with return receipt to the courier whose address is specified on the accompanying document and shall also be reported to LA VITTORIA SRL, or by sending an email to info@felicecavallo.it.
WARRANTIES
Products purchased from www.felicecavallo.it are subject to the regulations, insofar as applicable, set forth in Art. 128 et seq. Legislative Decree 206/05 on sales contracts and guarantees concerning consumer goods.
This guarantee shall apply to products that present conformity defects and/or malfunctions that could not be detected at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e. in compliance with its intended use and with what is set forth in the technical documentation, if any, and in compliance with the various operating standards indicated therein.
In case of presence of defects, the customer is invited to send, using a Courier at his choice, the product to LA VITTORIA SRL, Strada Madonna della Vittoria n.145, -66100 - CHIETI (CH), packing it carefully in the original product packaging together with a copy of the purchase invoice.
The replacement product shall be shipped by LA VITTORIA SRL only after receipt of the defective product and of the above requested documents correctly filled in.
In the event that the Product is no longer available, LA VITTORIA SRL shall proceed, via bank transfer, to reimburse the cost indicated in the purchase order and the first shipping costs, within 14 working days after receipt of the defective Product.
JURISDICTION AND APPLICABLE LAW
The sales contract between the Client and LA VITTORIA SRL is concluded in Italy and regulated by the Italian Law.
For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of CHIETI.
COMPLAINTS
Any complaint shall be addressed to LA VITTORIA SRL, Strada Madonna della Vittoria n.145 -66100 - CHIETI (CH) Italy
RIGHT OF WITHDRAWAL (ART. 64 and following Legislative Decree no. 206/2005)
1. If the Client is a consumer (i.e. a natural person who purchases the goods for purposes that are not related to his professional activity, i.e. he does not make the purchase indicating in the order form to LA VITTORIA SRL a VAT number), he has the right to withdraw from the purchase contract for any reason, without any penalty and without prejudice to what is indicated in point 3 below; this right is reserved exclusively to natural persons (consumers), therefore it cannot be exercised by legal persons and natural persons acting for purposes that are related to their professional activity. The right of withdrawal shall be exercised by sending, within the peremptory term of 10 (ten) days, starting from the receipt of the goods ordered, a written communication to the head office of LA VITTORIA SRL by registered letter with acknowledgement of receipt. The communication may also be sent, within the same term, by telegram, telex, email and fax, provided that it is confirmed by registered letter with acknowledgement of receipt within the following forty-eight hours; the registered letter shall be deemed to have been sent in good time if delivered to the accepting post office within the terms provided by the Code or by the contract, where different.
2. To exercise this right, the Customer shall send by email to info@felicecavallo.it a request for withdrawal in which it will be necessary to also indicate the bank details necessary to return the sums paid; the system will send to the Customer by email a paper form that must be printed and sent by registered letter with acknowledgment of receipt within 10 days from the date of receipt of the goods, to LA VITTORIA SRL, Strada Madonna della Vittoria n.145 -66100 - CHIETI(CH) Italy. Upon receipt of the registered letter, LA VITTORIA SRL shall send by email to the Client the form for the exercise of the right of withdrawal provided with the authorisation number which shall be attached to the outside of the wrapping in which the product will be physically placed and sent to LA VITTORIA SRL within 10 days from the authorisation.
3. The right of withdrawal is subject to the following mandatory conditions
- the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
- the right does not apply to opened products
- the purchased goods must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment) including a copy of the print (return authorisation) issued by LA VITTORIA SRL; the affixing of labels or adhesive tapes directly on the original packaging of the product must be avoided in all cases
- you trust in order to be able to take advantage of the shipment tracking service and the additional shipment insurance service);
- the shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer;
- in case of damage to the goods during transport, LA VITTORIA SRL shall notify the Customer of the event (within 5 working days from the receipt of the goods in its warehouse), to allow him to file a timely complaint against the courier chosen by him and to obtain reimbursement of the value of the goods (if insured); in this case, the product shall be made available to the Customer for its return, simultaneously cancelling the request for withdrawal;
- LA VITTORIA SRL shall not be liable in any way for damages or theft/loss of goods returned by uninsured shipments.
4. Without prejudice to any costs of restoration for damages ascertained to the original packaging, LA VITTORIA SRL shall refund the customer the amount already paid (excluding shipping costs), within 14 days from the return of the goods, by means of transfer of the amount charged on the Credit Card or by Bank Transfer. In the latter case, it shall be the customer's responsibility to promptly provide the bank details on which to obtain the refund (ABI - CAB - Current Account of the invoice holder).
5. The right of withdrawal shall be totally forfeited, for lack of the essential condition of integrity of the goods (packaging and/or its content), in cases where LA VITTORIA SRL ascertains
- the lack of the authorisation form issued by email by LA VITTORIA SRL following the client's request;
- the lack of the external packaging and/or the original internal packaging;
- the damaging of the product for causes other than its transport. In the case of forfeiture of the right of withdrawal, LA VITTORIA SRL shall return the purchased goods to the sender, charging the same for the shipping costs.
